By engaging our services, you agree to the following terms and conditions:

1. Services Offered

Dizzielizness specializes in:

  • Embellishments for garments.

  • Sewing and creating custom garments for fashion, dance, theatre, drag queen, and LGBTQI+ performances.

  • Bespoke garment design tailored to your specifications.

2. Payment Terms

  • Pricing for services will be provided upon consultation.

  • A deposit is required to confirm your booking (percentage specified at the time of agreement).

  • Full payment is due upon delivery of the final product unless otherwise agreed in writing.

  • Payments must be made within the agreed timeframe as indicated on your invoice.

3. Materials and Costs

  • Materials will be supplied by Dizzielizness unless otherwise arranged.

  • Additional material costs will be itemized and billed separately.

  • Any pre-approved expenses incurred during the project will be reimbursed by the client.

4. Turnaround Time and Delivery

  • Deadlines will be confirmed during the consultation process.

  • Any changes to the agreed delivery timeline must be approved in writing.

  • Dizzielizness is not responsible for delays caused by circumstances beyond our control, such as supply shortages, weather, or client-related delays.

5. Client Responsibilities

  • Accurate measurements and design requests must be provided in writing.

  • Timely approval of designs or project stages is necessary to avoid delays.

6. Changes to the Scope of Work

  • Any additional services or modifications to the agreed scope must be approved in writing.

  • Changes may affect fees and deadlines.

7. Intellectual Property

  • Designs remain the property of Dizzielizness until full payment is received.

  • Upon payment, the client is granted a non-exclusive, royalty-free license to use the designs for their intended purpose.

  • Dizzielizness reserves the right to use designs for marketing and promotional purposes unless the client requests otherwise in writing.

8. Confidentiality

  • Any non-public information shared during the project will remain confidential.

9. Cancellations and Termination

  • Either party may cancel the project with prior written notice (terms defined upon consultation).

  • The client will be billed for completed work up to the cancellation date.

  • In cases of personal emergencies or force majeure, deposits will be refunded, or the project rescheduled by mutual agreement.

10. Liability

  • Dizzielizness is not liable for incidental or consequential damages from using garments or services.

  • The client indemnifies Dizzielizness against any claims related to the use of delivered products.

11. Workplace Health and Safety

  • All work complies with NSW and Australian workplace health and safety regulations.

  • Clients must ensure a safe working environment for on-site services.

12. Dispute Resolution

  • Disputes will first be addressed through mediation.

  • If unresolved, disputes will be governed by the laws of New South Wales, Australia.

13. Governing Law

  • These terms and conditions are governed by the laws of New South Wales, Australia.

14. Additional Notes

  • Consultations are required for all custom projects.

  • Quotes provided are valid for a limited time and may be subject to adjustment if not confirmed within the specified timeframe.
